姦殺淫魔逃過死刑 王育敏要求提非常上訴

【何哲欣／台北報導】雲林國二葉姓少女遭累犯林國政性侵殺害，一、二審法官都判林國政死刑，但最高法院昨改判林無期徒刑，國民黨立委王育敏上午發新聞稿，痛批最高法院判決罔顧公理正義，司法體系保障兒少人權的最後防線蕩然無存，對此表達最深的憤怒與哀痛。

王育敏說，本案被害人是國二學生，依《兒童及少年福利與權益保障法》，林國政應加重其刑至二分之一，但最高法院法官卻未參酌《兒少法》，判決顯有疏失！另外又僅以林國政患有精神疾病為由，改判無期徒刑，顯漠視被害少女遭性侵、勒斃過程中的身心痛楚，導致被害人司法正義無法伸張！而林國政曾因兩度性侵等案，服刑十多年，出獄後又犯下兩起強盜案，隨後再犯下本案，實屬累犯，且惡行重大，顯有與社會永久隔離之必要！但最高法院竟認為再犯可能性低，改判無期徒刑，悖於常理，顯有違公理正義與社會期待！
 
王育敏說，已主動發文給檢察署檢察總長黃世銘，要求黃依《刑事訴訟法》規定，儘速向最高法院提起「非常上訴」，希望為受害的葉姓少女及其家屬爭取應有的公道。
