一塊土地(假設地號為:泰山段38地號)分別由ABCDE五人持有,並無分管契約,共有人皆有各自行使之範圍(使用籬笆區隔)及蓋鐵皮屋。
1.如今A的土地旁有塊國有地(假設地號為:泰山段38-1地號),問ABCDE皆可購買嗎?
2.若B要購買是向國產局申購,是否需要ACDE的承購權拋棄書?其程序為何?
3.因A在國有地上(泰山段38-1地號)蓋鐵皮屋,得知已蓋超過10年,是否A就有優先承購權?
4.泰山段40地號之土地所有權人是否可購買泰山段38-1地號之國有地?
5.若要申請「畸零地合併使用證明」是否只有A可以申請,因與A地相鄰?
