起乩揮掃把刺瞎翁　男重傷害判3年4月

59歲陳姓男子去年9月間，在北市和平東路黎忠公園內突然起乩，持竹掃把揮舞，不慎刺中到公園運動，坐在椅子休息的劉姓老翁右眼，致劉右眼球破裂喪失功能而裝義眼，台北地院認定陳構成重傷害罪，日前判陳3年4月徒刑，全案可再上訴。
 
陳男坦承刺傷劉姓老翁右眼，但否認重傷害犯行；他辯稱，當時站在石椅上拿竹掃把跳乩童，跳到另張椅子時，坐在椅子上的劉翁突拿柺杖攻擊他，才拿掃把抵擋，豈料劉翁剛好站起來，才會被竹掃把刺傷，沒有傷害故意。
 
法官根據劉雲鵬描述事發情節及診斷證明，認定陳刺瞎劉翁右眼屬實，但審酌陳已與劉翁和解，且坦承部分犯行，因此依重傷害罪輕判他3年4月徒刑。
